Terms of service

Based on Standard Purchase Terms from the Norwegian Consumer Authority

When you shop on riderinbalance.com, your purchase is governed by the following terms of sale for consumer purchases of goods over the internet. Consumer purchases over the internet are primarily regulated by the Contract Act, the Consumer Purchases Act, the Marketing Act, the Right of Withdrawal Act, and the E-commerce Act. These laws provide you, as a consumer, with non-waivable rights. The laws are available at lovdata.no.

It is emphasized that the terms of this agreement should not be understood as a limitation of the statutory rights but rather outline the most important rights and obligations of the parties, in this case, riderinbalance.com and you as a customer, in the transaction.

The primary basis of these terms of sale has been developed and recommended by the Norwegian Consumer Authority. For more information, visit forbrukertilsynet.no.

The agreement consists of these terms of sale, information provided in the payment solution (Klarna, VIPPS, or Stripe card payment), and any specifically agreed-upon terms. In the event of any conflict between these sources, the specifically agreed-upon terms between the parties take precedence, provided they do not contradict mandatory legal provisions.

The agreement is further supplemented by relevant legal provisions regulating the purchase of goods between businesses and consumers. In this case, Rider In Balance AS and you as a customer of riderinbalance.com.

The seller is Rider In Balance AS, Kalneset Gård, Røgdestranda 399, 2256 GRUE FINNSKOG, post@riderinbalance.com, NO 915545823 MVA, hereinafter referred to as the seller.

The buyer is the consumer placing the order on riderinbalance.com, hereinafter referred to as the buyer.

3. PRICE

The stated price of the product and services is the total amount the buyer must pay. This price includes all taxes and additional costs. Any additional costs not previously informed about before the purchase shall not be borne by the buyer.

4. CONCLUSION OF THE AGREEMENT

The agreement is binding for both parties once the buyer has submitted their order to the seller.

However, the agreement is not binding if there are obvious typographical or pricing errors in the seller’s offer, in the ordering system of the online store, or in the buyer’s order, and the other party knew or should have known that such an error existed.

5. PAYMENT

The seller may require payment for the item from the time it is shipped to the buyer.

If the buyer uses a credit card or debit card for payment, the seller may reserve the purchase amount on the card at the time of ordering. The card will be charged on the same day the item is shipped.

If the buyer pays by invoice, the invoice will be issued upon dispatch of the item. The payment deadline is stated on the invoice and is at least 14 days from receipt.

Buyers under 18 years old cannot pay by post-payment invoice.

6. DELIVERY

Delivery is considered completed when the buyer, or their representative, has received the goods.

If no specific delivery offer is mentioned in the ordering system, the seller must deliver the goods to the buyer without undue delay and no later than 30 days from the date of purchase. The goods shall be delivered to the buyer’s address, unless otherwise agreed.

7. RISK FOR THE GOODS

The risk for the goods transfers to the buyer once the goods have been delivered according to section 6.

8. RIGHT OF WITHDRAWAL

Unless otherwise agreed, the buyer can withdraw from the purchase in accordance with the Right of Withdrawal Act. More information about the right of withdrawal is available at the Norwegian Consumer Council: Forbrukerrådet

The buyer must notify the seller about exercising the right of withdrawal within:

  • 100 days for bed linens
  • 30 days for towels

This period includes all calendar days. If the deadline falls on a Saturday, public holiday, or national holiday, it is extended to the next working day.

The withdrawal deadline is met if the notification is sent before the deadline expires. The buyer bears the burden of proof, so the withdrawal notice should be in writing (via withdrawal form, email, or letter).

9. DELAY AND NON-DELIVERY – BUYER’S RIGHTS

If the seller fails to deliver the goods or delivers them late, and this is not due to the buyer’s actions, the buyer may:

  • Withhold payment
  • Demand fulfillment
  • Cancel the purchase
  • Claim compensation

The claim should be made in writing for evidence purposes.

10. DEFECTS IN THE GOODS – BUYER’S RIGHTS

If there is a defect in the goods, the buyer must notify the seller within a reasonable time after discovering it. The buyer has always complained in time if it is within 2 months after the defect was found. The complaint period is generally 2 years, or 5 years if the product is meant to last significantly longer.

The buyer may:

  • Withhold payment
  • Request repair or replacement
  • Demand a price reduction
  • Cancel the purchase
  • Claim compensation

11. SELLER’S RIGHTS IN CASE OF BUYER’S BREACH

If the buyer fails to pay or otherwise breaches the agreement, the seller may:

  • Retain the goods
  • Demand payment
  • Cancel the purchase
  • Claim compensation

The seller may also charge late payment interest, collection fees, and a reasonable fee for unclaimed goods.

12. WARRANTY

Any warranty provided by the seller or manufacturer grants the buyer additional rights beyond those required by law. A warranty does not limit the buyer’s rights under sections 9 and 10 regarding defects or delays.

13. PERSONAL DATA

The seller is responsible for handling collected personal data in accordance with the Personal Data Act. The seller only collects necessary data for fulfilling the agreement. Personal data is not disclosed unless required for fulfilling the agreement or by law.

14. DISPUTE RESOLUTION

Complaints should be directed to the seller within a reasonable time (see sections 9 and 10). The parties should attempt to resolve disputes amicably.

If this is not successful, the buyer may contact the Norwegian Consumer Council for mediation.
